Controversial managing agent and chartered surveyor Benjamin Mire (right) appeared before the property tribunal in 52 cases since 1999, according to a Ministry of Justice statement.
But he only sat on the panel as a judicial officer 14 times between 2007 and 2010, which was the last year he did so.
The figures were released to Sir Peter Bottomley, Conservative MP for Worthing West, in a letter from Shailesh Vara, Minister for the Courts and Legal Aid.
The figures concerning Mire’s appearances before the tribunal were obtained by the Ministry of Justice from the LEASE database of tribunal cases.
Benjamin Mire is the managing director of Trust Property Management in Colindale, north London. His firm manages the interests of Lakeside Developments, headed by David Glass, on whose behalf he repeatedly appeared before the tribunal.
Mr Vara advised that any leaseholder with an interest in Benjamin Mire would be able to read the finding of the Judicial Conduct Investigation Office here
The statement makes clear that Benjamin Mire would have been sacked had he not resigned his judicial appointment.
“Following a number of complaints made against Mr Benjamin Mire, a part-time Valuer Chair of the Southern Residential Property Tribunal, a conduct investigation recommended Mr Mire’s removal from judicial office. The matter was referred to a Review Body to consider the complaints further. The Review Body found Mr Mire had failed to observe the standards that could reasonably be expected of a judicial office holder and that this failing was sufficiently serious to justify his removal from office. Mr Mire resigned from judicial office before the disciplinary process could be concluded. His resignation took effect from 16 July 2013.”

If Mr Mire was not thought to be not fit to continue as a judicial officer, how can he be fit to operate in property management?

Did he show up at a hearing without a tie? With a tie resembling an iridescent fish? Or did he fail to declare when he had a conflict of interest and recuse himself?
Why can’t the legal profession call a spade a spade?
In the 14 LVT appearances what was the outcome for the Respondents, will the cases be reviewed, as decision may have been flawed?
Has any reader information on the 14 cases and what effect did the result have?
Be it Benjamin Mire, LVT(Upper Tribunal) Peverel(who I may have mentioned on some occasions!) ARMA, ARHM, OFT, SFO, Local Authorities, i cannot think of a single part of leasehold that is not broken and not in urgent need of complete reform.

If you go to the Leasehold Advisory Service website and go to LVT decisions, then type in “Mire” in the search box, a list will appear. .
I am delighted to see that this/these organisation/s is/ are being seriously looked at. However, I do feel that more in depth research is required to find out exactly who has been benefitting from these organisations and their scurrilous activities. I suspect that one or two high profile political names will head any list eventually compiled.
